Forever Family Guardian Contract

1. - The Guardian hereby acknowledges that the purpose of this agreement is for the Guardian to acknowledge that they are taken physical possession of a dog owned by the Breeder. The Guardian acknowledges that this agreement is being entered into in an effort to expand the breeding program of the breeder. The Guardian understands that all breeding decisions will be made by the Breeder and that the Guardian will not interfere in any decisions about breeding the dog listed in this agreement. The purpose of the Guardian is to Guard the interests of the Breeder and uphold all wishes expressed by the Breeder in the care, and breeding of the dog. The Guardian understands that at times, the Breeder may make breeding decisions that go against the wishes of the Guardian, but that any and all breeding decisions will be solely made by the Breeder, and upheld by the Guardian.
2. - The Breeder is the sole owner of the dog and therefore maintains sole authority regarding all aspects of the dog's well-being including (but not limited to) it's health, safety, socialization, temperament, training, and placement.
3. - The Breeder will pay only pre-approved and authorized veterinary expenses related to the breeding of the dog. The Guardian will be required to pay for normal routine veterinary care such as vaccinations, and deworming. The Guardian will be required to pay for the dogs food.
4. - The breeder will not be held liable for any accident or injury that occurs while the Guardian has physical control of the dog.
5. - The guardian is expected to provide adequate food, shelter, exercise, and control over the dog.
6. - In the case of the dog being a female, The Guardian agrees to make known to the Breeder immediately when the dog has valvular swelling and bleeding as this indicates when the breeding shall take place.
7. - The Guardian will aid in the delivery of the dog to the Breeder for breeding purposes.
8. - The Guardian agrees that they will procure the dog listed in this agreement for a veterinary appointment with 2 day notice by the Breeder at a Veterinarian of the Breeders choice. The purpose of this is to protect the provability that the Breeders Veterinarian agrees to the breeding soundness and capability of the dog. There shall be no Veterinary opinions establishing that the dog is not a good breeding candidate by the Guardians Veterinarian. Any Veterinary opinions as to the breeding soundness and capability will be solely by the Breeders Veterinarian.
9. - If the Guardian would like to withdraw from the Guardian program they will be required to return the dog to the Breeder.
10. - At the time that the Breeder in their experience, feels that the dog should be retired, the Breeder may elect to gift the ownership of the dog to the Guardian. The Breeder is solely in control of determining when the dog is done breeding. This is usually anywhere from 3-4 litters.
11. - The Guardian understands that it is their sole responsibility that there are no unintended breedings of the dog listed in this agreement. In the case of breeding to a female guardian dog by any male dog that was not approved of by the Breeder, the Guardian agrees to immediately withdrawal from the Guardian program and relinquish the dog immediately to the Breeder at the Breeders request. The Guardian also agrees to pay a fee of $4,000 for the the Guardian dog if they fail to return the dog to the Breeder at the Breeders request. The Guardian agrees to pay this penalty fee within 6 months of notice by the Breeder. Notice being a text message, email, or voicemail.
12. - It is deemed that this contract is initiated and finalized in Weber County, Utah. Any legal action brought by the Buyer or the Breeder will be preceded with a court-appointed mediator. Any legal action will be ignited only in the county of initialization and finalization which is Weber County, Utah.
13. - Guardian agrees by signing below, to all the terms of this agreement included in sections 1-13. This agreement by the Breeder and the Guardian is a binding contract and is the only expressed agreement between the Breeder and the Guardian.
